Mr. Kaushik Choudhury ....for the petitioner Mr. Arijit Ganguly Ms. Baishakhi Chatterjee ....for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the only material available against the petitioner is the statement of a co-accused, which is not admissible in evidence. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that other than the statement of a co-accused available in the case diary, there is a criminal antecedent against the petitioner being, Gangarampur P.S. Case No. 531 of 2022 in which a charge sheet dated 05.05.2023 was submitted. The same involved offences under the NDPS Act. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.
