The petitioner apprehends that he may be taken into custody as warrant of arrest has been issued against him in connection with Bagnan Police Station Case No. 289 of 2018 dated 28.07.2018. A report has been submitted on behalf of the State which reflects that further investigation of the case is in progress. Let the said report dated 08.04.2024 be kept with the record.

However, having regard to the fact that warrant of arrest has been issued and the petitioner was earlier on bail, I direct that in case the petitioner appears and surrenders on or before 10.05.2024 and the learned Magistrate on inspection of the records finds that the petitioner was earlier on bail, the learned Magistrate would allow the petitioner to continue on the same bail and bond, however, it would be the discretion of the learned Magistrate to impose conditions as he deems fit and proper for compelling or ensuring appearance of the petitioner on subsequent dates. In case the petitioner do not appear or surrender on or before 10.05.2024, the learned trial court would be at liberty

to resort to harsher process of law by adhering to the provisions of Section 82 of the Code of Criminal Procedure. With the aforesaid observations, the revisional application being CRR 1135 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
