None appears on behalf of the panchayat authorities despite service.

The petitioner worked as a Group-D employee under the Bhangore Gram Panchayat. The petitioner retired from service on June 30, 2007. It is the contention of the petitioner that the Pension Payment Order was issued on June 18, 2007 and the petitioner has been granted the retirement benefits as per ROPA 1998. It is the contention of the petitioner that after the revision of pay and allowances in 2009 and thereafter, the benefits of such revision has not been given to the petitioner. The petitioner prays that the concerned authorities be directed to fix the pension payable to the petitioner as per the revised ROPAs.

Having considered the contentions of the petitioner, the court finds some substance in the allegations of the petitioner.

The writ petition is disposed of with a direction upon the respondent no. 5 to treat the writ petition as a representation and dispose of the same in accordance with law upon granting an opportunity of hearing to the petitioner as also the gram panchayat authorities, where the petitioner had worked. A decision shall be passed and communicated to the petitioner with reasons within a period of three months from the date of communication of this order.

The writ petition is, thus, disposed of. There shall be no order as to costs.
