Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent nos.2 to 6 to forthwith release of due arrear salary to the petitioner.

The petitioner contends that by resolution of the Suri-I, Panchayat Samity Suri, Birbhum dated 16th Augtust, 2017 the petitioner was appointed as a technical staff with salary of Rs.15,000/- per month. In the year 2019, the salary of the petitioner was increased to Rs.20,000/- per month with deduction of provisional tax of Rs.113/- per month. From January, the petitioner's salary remained unpaid. The petitioner has rendered service till November, 2023. There is a due of

Rs.4,38,000/- payable to the petitioner from January, 2021 to November, 2023. The petitioner made representation before the respondent no.6, the Block Development Officer, Suri-I Development Block. However, till date such dues remain unpaid. Hence, this writ petition.

Mr. Bibek Jyoti Basu, learned Advocate for the petitioner submits that the matter be relegated to the respondent no.6, the Block Development Officer, Suri-I, Development Block & Executive Officer, Suri-I Panchayat Samity, Kalipur, Birbhum 5 to consider the representation of the petitioner within a stipulated period.

Mr. Amal Kr. Sen, leaned Additional Advocate General, appearing on behalf of the State leaves the matter to the discretion of this Court.

Upon hearing the petitioner and the learned Advocate for the State the writ petition being WPA 7707 of 2024 is disposed of directing the respondent no.6, the Block Development Officer, Suri-I Development Block & Executive Officer, SuriI Panchayat Samity to consider and dispose of the representation of the petitioner dated 10th January, 2024 upon notice and hearing the parties including the petitioner and all concerned in accordance with law by passing a reasoned order within a period of four weeks from the date of communication of this order.

Reasoned order shall be communicated to the petitioner within a period of one week from the date of passing thereof.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.6, the Block Development Officer, Suri-I Development Block for necessary compliance.

It is made clear that this Court has not gone into the merits of this writ petition.

10.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

11.

Interim order, if any, stands vacated.

12.

All connected applications, if any, stand disposed of.

13.

There shall be no order as to costs.

14.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

15.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
