The main grievance of the petitioner in the present writ petition is that the private respondent has illegally occupied the land of the PWD due to which the petitioner is facing difficulties to ingress and egress of his residence. The petitioner has made a written complaint to all the authorities on 20.01.2025 and on receiving the said complaint, the Executive Officer, - Midnapore Kharagpur Development Authority by a letter dated 22.01.2025 forwarded the complaint to the SubDivisional Officer, Kharagpur to enquire into the matter and taking suitable action.

Learned Counsel for the petitioner submits that inspite of receipt of the complaint and the complaint forwarded by the Executive Officer, till date no action has been taken by the Sub-Divisional Officer and the private respondent is still in illegal occupation of the

PWD land due to which the petitioner is facing difficulties.

This Court finds that no purpose would be served by keeping the writ petition pending. Accordingly, without calling for the affidavits at the motion stage the present writ petition being WPA 7070 of 2025 is disposed of by directing the Sub-Divisional Officer, Kharagpur to dispose of the representation/complaint filed by the petitioner dated 20.01.2025 which was also forwarded by the Executive Officer, MKDA & ADM, Paschim Medinipur to the Sub-Divisional Officer dated 22.01.2025 within a period of six weeks after giving an opportunity of personal hearing to the petitioner and private respondent.

It is made clear if during the enquiry it is found that the private respondent is in illegal occupation of any land or property of PWD, the Sub-Divisional Officer, Kharagpur shall immediately take appropriate steps for eviction of the private respondent over the illegal occupation. The decision shall be communicated to the petitioner immediately.

With the above direction, WPA 7070 of 2025 is disposed of.
