Mr. Diganta Bose ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), Kakdwip to dispose of Title Suit No.134 of 2012 expeditiously.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge. From the order sheets appended to the application this Court finds that the several dates were fixed directing the plaintiff to take steps for service of summons upon some of the defendants.

From the order dated February 22, 2024, this Court finds that August 2, 2024 was fixed for taking steps

upon the rest of the defendants and only the plaintiff and the defendant No.1 filed hazira.

After going through the order sheets appended to this application, this Court finds that the service of summons upon the defendants is yet to be completed. In view thereof, no direction for expeditious hearing can be passed at this stage.

With the above observations CO 1119 of 2025 stands disposed of giving liberty to the petitioner to approach this Court after the suit is made ready for hearing.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
