Affidavit-of-service filed on behalf of the petitioner is taken on record.

The learned advocate representing the petitioner submits that a transfer application has been made by her on 10th February, 2025 in the prescribed format and the school authority where petitioner is presently working has given No Objection on 29th January, 2025 for petitioner's transfer.

It is further submitted that transfer application was submitted before the concerned District Inspector of Schools (SE), Murshidabad on 11th February, 2025 but thereafter no steps have been taken by the concerned respondent authorities for processing the transfer application of the petitioner.

It is also submitted on behalf of the petitioner

that till date petitioner has not been medically examined by the concerned medical officer.

The District Inspector of Schools (SE), Murshidabad being respondent no.4 is directed to obtain medical report on medical examination of the petitioner from the concerned Chief Medical Officer of Health/Medical Board by four weeks from the date of communication of this order.

In the medical report concerned CMOH/Medical Board is required to certify considering nature of ailment of the petitioner whether she is required to avoid long distance journey or not. If medical report justifies transfer of the petitioner respondent no.4 shall forward the transfer application along with medical report to the Chairman, West Bengal Central School Service Commission being respondent no.3 by fortnight thereafter and on receipt of same the respondent no.3 shall decide the same by four weeks thereafter.

The decision to be taken by the respondent no.3 shall be communicated to the petitioner by ten days thereafter.

However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner.

The writ petition stands disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
