The petitioner is aggrieved by the action on the part of the banking Ombudsman in closing the complaint filed by the petitioner without granting any opportunity of hearing.

From the impugned order of the Ombudsman, it appears that though the complaint of the petitioner stood closed, but the petitioner was granted liberty to file a fresh complaint.

Learned counsel for the Ombudsman submits, upon instruction that, the petitioner did not file any complaint in the manner as has been stated in the impugned order.

It appears that the principal grievance of the petitioner is against South Indian Bank. There is commercial agreement between the petitioner and South Indian Bank.

The writ Court will not be in a position to decide the disputed questions of fact between the

parties.

6.

The writ petition thus fails and is hereby dismissed.

7.

It will be open for the petitioner to take steps in the matter in accordance with law, if so advised. 8.

Exception to the report of Reserve Bank of India filed in Court be taken on record.

9.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

10.

Certified copy of this order, if applied for, shall be made available to the parties.
