Leave granted to the learned advocate on record of the petitioner to correct the spelling of the name of the petitioner appearing in the cause title of the writ petition. The proper name should read as Mortuja Ali. The petitioner seeks consideration of the representation filed before the Block Development Officer praying for releasing the payment in terms of the Work Order issued in his favour vide Memo No. 112/Krishnapur GP-serial No. 3 dated 12th June, 2017. None represents the respondents.

In the absence of the respondents the matter cannot be decided conclusively.

As it appears that the representation filed by the petitioner is pending consideration before the Block Development Officer, Kaliachak III, accordingly, the instant writ petition is disposed of by directing the respondent no. 7 to consider and dispose of the representation filed by the petitioner in accordance with law and in terms of the Work Order issued in his favour at the earliest. An opportunity of hearing shall be given to the petitioner to produce documents in support of his claim.

The Block Development Officer shall pass a reasoned order and communicate the same to the petitioner immediately thereafter. If it appears that the claim of the petitioner is genuine, then necessary consequential steps shall be taken in the matter. The Block Development Officer shall take steps positively within a period of four months from the date of communication of this order.

Learned advocate for the petitioner is directed to forward a copy of the Work Order, the representation before the Block Development Officer and the documents in support of his claim to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
