-Vs.- The State of West Bengal Mr. Amal Krishna Samanta Mr. Arun Kumar Das ....For the Petitioners This is an application filed by the petitioners for quashing of the proceeding being G.R. Case No. 1832 of 2014 arising out of Panskura Police Station Case No. 407 of 2014 dated 13.08.2014 under sections 323/354/506/34 of the Indian Penal Code and sections 3(i)(x)(xi)(xv) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, relating to M.P. Case No. 677 of 2014.

The matter was taken up by a coordinate Bench of this Hon'ble Court on 22.04.20215, when none appeared on behalf of either of the parties. It was observed by Hon'ble Justice Joymalya Bagchi (as His Lordship then was) that the disputes are likely to be settled between the parties amicably and a direction was given to the learned Public Prosecutor to file a report as to whether the parties have amicably settled their disputes on the next date of hearing.

The matter was never appeared thereafter. No interim order was ever granted.

On 28.03.2025, Mr. Arun Kumar Das, learned advocate appeared for the petitioners and prays for accommodation. Today, the learned advocate submits by filing an affidavit of service that he has intimated the petitioners about this matter but received no instruction. It is further submitted that he is not willing to appear in this case in the absence of any specific instruction.

Let the affidavit of service be kept with the record. Considering the above facts and circumstances, this Court finds no reason to keep the matter pending any further. Hence C.R.R. 671 of 2015 stands dismissed for default. Let a copy of the order be forwarded to the learned Trial Court for information.
