Mr. Roy Chowdhury appearing for the State submits, on instructions, he has come to know that the investigation of the case has already been concluded.

Learned advocate for the petitioner submits that he is aggrieved by the conditions imposed by the learned Additional Chief Judicial Magistrate, 2nd Court, Alipurduar in respect of the return of vehicle. According to the learned Advocate conditions of bank guarantee are very difficult to be implemented in view of the conditions required for furnishing Bank Guarantee.

In the circumstances, I modify the order dated 21/11/2017 to the effect that instead of furnishing Bank Guarantee of Rs.3 lakhs "the petitioner shall be allowed to furnish personal bond of Rs.10 lakhs (Rupees Ten lakhs)". So far as the other conditions so imposed the same would remain unaltered.

With the aforesaid observations, CRR 956 of 2018 is disposed of.

Pending application, if any, is consequently disposed of. All parties are to act on the server copy of this order, duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
