An order under Section 7A of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952 was passed against the petitioners on 21st July, 2017. The petitioners prayed for review of the said order and also preferred an appeal, both of which were dismissed. A further representation was made by the petitioners before the authority for an opportunity to produce documents for rectification of the demand which was much in excess of what was due from the petitioners. Pursuant to the said representation, the petitioners were called for a hearing by the authority on 27th July, 2018. The petitioners submit that the respondent authority did not dispose of the representation submitted by the petitioners and pending such representation, the bank account of the petitioners was attached. The authority has initiated further proceedings for recovery of the amount due.
Per contra, it is submitted on behalf of the respondents that the order impugned demonstrates that the petitioners accepted and agreed with the enquiry
officer's report dated 27th April, 2016 and submitted that the establishment was ready to pay all dues.
The report of the enquiry officer dated 27th April, 2016 is not on record.
Learned counsel for the respondents seeks accommodation to submit a copy of the comprehensive report along with other documents in the form of affidavit. Let the matter appear under the same heading on 13th July, 2022.
