1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is serving as the Block Disaster Management Officer. He was posted in Murshidabad and he has been transferred to English Bazar, Malda. His home district is Nadia.

3. He submits that his mother is a widow suffering from various old age ailments and undergoing treatment in Chapra, Nadia. Apart from him there is no one to look after and take care of his aged ailing mother.

4. He was earlier transferred from Chapra to Murshidabad which he challenged by way of a writ petition being WPA 9574 of 2023 which stood dismissed by the Court on 12th June, 2023.

5. The petitioner preferred an appeal against the order of dismissal and vide order dated 5th March, 2024 passed in MAT 1189 of 2023 the Hon'ble Division Bench requested the Director of Disaster Management to reconsider the application of the

petitioner on medical ground of his mother, if permissible under the Rules.

6. It has been submitted that despite order passed by the Hon'ble Division Bench, the authority did not reconsider the prayer of the petitioner for transfer to his hometown. The petitioner has again been transferred from Murshidabad to Malda which is very far away of his hometown and it will practically be impossible for the petitioner to take care of his mother and continue with his duty simultaneously.

7. Prayer has been made to consider transferring him to Nadia.

8. None appears on behalf of the respondents.

9. On a perusal of the documents annexed to the writ petition, it appears that the transfer order was passed on 11th March, 2026. The petitioner was not the only one to be transferred. Six Blok Disaster Management Officers were transferred in the interest of public service.

10. It appears that after the order of transfer was passed there is no representation from the petitioner requesting posting him at his home district Nadia.

11. In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to apply before the authority highlighting his grievances annexing supporting documents.

12. In the event such a representation is made, then the same shall be considered by the Director, Disaster Management, West Bengal in accordance with the prevailing Rules at the earliest but

positively within a period of six weeks from the date of filing the representation.

13. The fate of the representation shall be made known to the petitioner immediately thereafter.

14. The writ petition stands disposed of.

15. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

16. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
