And In Re :

Subodh Kumar and another ... Petitioners.

Mr. Moyukh Mukherjee, Mr. Manojit Debnath ... For the Petitioners.

Mr. Sanjay Banerjee, Ms. Afreen Begum ... For the State.

Learned advocate appearing for the petitioners submits that the petitioners are in custody for 2 years 10 months and are similarly placed as the other accused who has been granted bail ion 02.04.2026 in CRM (NDPS) 529 of 2026.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail on several grounds, but is unable to refute the contention of the petitioners that the present petitioners are not similarly placed as the accused who has been granted bail.

Having considered the reasons which were assigned while granting bail to the other accused, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioners is allowed.

Accordingly, the petitioners viz., 1. Subodh Kumar and

2. Samrat Sarkar shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Barrackpore.

If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of North 24-Parganas without prior permission of the learned Special Court.

Additionally, petitioners shall meet with the Officer-inCharge of the local police station where they would reside once in a week till further orders and acknowledgement be obtained from the concerned police personnel whom they would be meeting and the same is submitted before the learned Special Court on the date fixed.

The application for bail, being CRM (NDPS) 595 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
