Case No.456 of 2025 dated 04.08.2025 under Sections 316(2), 318(4), 319(2) of the BNS, 2023. And In the matter of: Atul Thakur alias Atul ... petitioner Mr. Saikat Debnath ... for the petitioner Mr. Subhamoy Bhattacharya Mr. Raju Mondal ... for the State Learned counsel for the petitioner submits that it was alleged that the accountant of the de facto complainant's company received a fake whatsapp message, purportedly from the profile of the de facto complainant requesting to send Rs. 20 lakhs urgently to a bank account. The profile contained the picture of the de facto complainant. This prompted the accountant to send the money to the said account. The petitioner is not at all responsible for the fraud in question.

Learned counsel for the State opposes the prayer for anticipatory bail and submits that the bank account from which the money was transferred belongs to the present petitioner. Thereafter, the money was taken to other accounts and was transferred again to several other accounts. The petitioner did not comply with the notices issued.

Considering the above, the other incriminating materials available in the case diary and the fact that the petitioner did not cooperate with the notices issued, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
