This Court had kept this contempt application pending on being dissatisfied with the action of the Commissioner of Bidhannagar Municipal Corporation, solely on the ground that although there were allegations of unauthorized construction, but the logical conclusion had not been reached by the authority, by directing the persons involved in the alleged unauthorized construction to demolish the structure.
The demolition order which was later passed, during the pendency of the contempt application, was challenged before the learned Coordinate Bench having jurisdiction.
Learned Coordinate Bench set aside the order of demolition and asked the authority to comply with the order which was earlier passed by this Court.
At this juncture, nothing remains to be decided in this contempt application.
The contempt application is disposed of. The contempt proceedings are dropped.
All the parties are directed to act on the basis of the server copy of this order.
