For the Petitioner Mr. P.K. Datta, ld. APP Mr. Subrata Roy, Advocate ... ...For the State In re : CRAN 2 of 2021 Petitioner seeks waiver of the conditions granting anticipatory bail on June 8, 2021.
Learned Advocate appearing for the petitioner submits that one of the conditions was waived by the order dated August 11, 2021. Now, since the police filed charge-sheet, the other conditions for anticipatory bail such as not entering the jurisdiction of the local police station and reporting to the Officer-in-Charge of the concerned police station should be waived.
Learned Advocate appearing for the State submits that there is not adverse report.
The communication dated March 28, 2022 to such effect filed in Court be taken on record.
The police filed charge-sheet. There exists an order of anticipatory bail in favour of the petitioner dated June 8, 2021. One of the conditions of anticipatory bail of not entering the jurisdiction of local police station was not waived on August 11, 2021.
At that time the charge-sheet was not submitted. The police filed charge-sheet subsequently.
In such circumstances, it would be appropriate to waive the conditions restraining the petitioner from entering
into the jurisdiction of the local police station. Such condition in the order dated June 8, 2021 is relaxed.
All other conditions of the order dated June 8, 2021 will remain the same.
CRAN 2 of 2021 is, thus, disposed of.
