1. The learned counsel for the petitioner submits that in spite of the State Administrative Tribunal's order dated 06.08.2024 directing the respondent/State to handover the decision of the authorities regarding the petitioner's claim for compassionate appointment within 30 days, no decision has been communicated to the petitioner till date.

2. If that be the situation, we are of the considered view that at best it gives rise to a cause for invoking appropriate jurisdiction of the Tribunal for non-compliance with its order. Such noncompliance does not give an opportunity to the petitioner to assail the order dated 06.08.2024, non-compliance of which is being alleged.

3. We thus dismiss the writ petition.

4. If, however, any order is communicated to the petitioner as a consequential of the directions passed by the Tribunal, it is needless to say that it is open to the petitioner to assail the same in appropriate proceedings, in accordance with law. (Madhuresh Prasad, J.) (Prasenjit Biswas, J.)
