In Re: An Application under Sections 482/401 of the Code of Criminal Procedure.

The present revisional application relates to an order dated 28.01.2021 in Criminal Appeal No. 12 of 2016. The subject-matter related to the order dated 25.02.2016 passed by learned Judicial Magistrate, Bidhannagar in C. Case No. 441 of 2015. The ground on which the learned appellate court rejected the appeal was that the State of West Bengal was not made a party in the appeal.

The records of this revisional application reflect that the revisional application initially appeared on 25.03.2021. The petitioner in person appeared and prayed for the matter to be listed on 05.04.2021. This revisional application again appeared in the list and on 12.04.2021, none appeared and the matter was adjourned. This matter has been running in the list and the petitioner is not represented for a considerable period of time. Having considered the conduct of the present petitioner, I am of the opinion that the revisional application being CRR 868 of 2021 should be dismissed for default.

All pending connected applications, if any, are consequently disposed of.
