Mr. Binoy Kumar Panday, learned advocate who usually appears for the State is present and is representing the State/Opposite Party. The appointment of Mr. Panday may be regularized by the concerned authority. This revision has been preferred under Section 407 of the Code of Criminal Procedure praying for transfer of Sessions Trial No. 8 (8) of 2010 corresponding to Sessions Case No 65(3) of 2010 under Section 302/120B/34 of the Indian Penal Code pending before Learned Additional District & Sessions Judge, Fast Track 9th Court at Alipore on the ground that the petitioner apprehends that he will be convicted in the case by Learned Trial Judge without free and fair trial and that Learned Trial Judge is inclined to
conclude the trial at the earliest despite illness of the petitioner.
This is an old matter pending since the year 2011. The concerned Judge, D.P. Biswas 9th F.T.C., Alipore has long been transferred from the Court. In my considered view, there is no merit in the application and the same is dismissed.
Let a copy of this order alongwith LCR, if any, be sent down to the 9th F.T.C., of Additional District & Sessions Judge, Alipore at once.
