Ganesh Mondal v. State Of West Bengal And ANR
28.04.2022 SB Ct. No.39 CRR 1265 of 2022 In the matter of : Ganesh Mondal Mr. Susnigdho Bhattacharyya... for the petitioner Mr. Anwar Hossain Md. Kutubuddin ... for the State This is an application challenging issuance of warrant of arrest against the petitioner.
Let a copy of the revisional application be served upon Mr. Anwar Hossain and Md. Kutubuddin, learned counsels, who ordinarily appear on behalf of the State. They are requested to appear in this matter. Their engagement may be regularised by the competent authority of the State in due course. Learned counsel appearing on behalf of the petitioner submits as follows. Although initially the petitioner was not named in the F.I.R., a charge sheet was subsequently submitted showing the petitioner as one of the accused. The petitioner was granted bail in 2016 and he regularly attended the Court. Thereafter in 2018 on two consecutive occasions, the petitioner failed to take steps. That is why warrant of arrest was issued against him on 27.02.2018. The same has remained pending. The petitioner wants to join the proceeding at the earliest Learned counsel appearing on behalf of the State submits that since the warrant of arrest was issued a long time ago, this is not a fit case to stay the same.
I have heard the submissions of the learned counsels for the petitioner and the State and have perused the revision petition. It would not be proper to stay the warrant of arrest as the same was issued long back in 2018.
However, the petitioner is directed to surrender before the learned Trial Court within four weeks from this date. In the event the petitioner surrenders before the learned Trial Court and prays for bail, his application for bail shall be considered in accordance with law.
With these observations, the revisional application is disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon completion of requisite formalities. (Jay Sengupta, J.)
