Petitioner submits that till date the application under Section 23 of the P.W.D.V Act, 2005 filed at her instance is pending and she is deprived of the reliefs under the Act, Learned advocate submits that the petitioner has filed her affidavit of assets and liabilities while the opposite parties till date did not file the same and are trying to stretch the time both for hearing of the application under Section 23 of the P.W.D.V Act and using the affidavit of assets and liabilities as a tool for such delay.

Having regard to the prayers so advanced and the records revealing that the next date has been fixed on 11th April, 2024, I direct that the learned Judicial Magistrate, 3rd court, Serampore, Hooghly or any court in charge of the said court would hear out the application under Section 23 of the P.W.D.V Act on 11th April, 2024 or within a fortnight from the said date and will not stretch the timeline irrespective of the fact whether the affidavit of assets and liabilities are filed at the instance of the opposite parties.

All efforts be taken so far as the main case is concerned by fixing one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 1151 of 2024 is disposed of.
