Ms. Sayanti Santra ... for the petitioner This is an application seeking an expeditious disposal of a proceeding in a complaint case being Case No. CS/113497/2016 under Sections 138 and 141 of the Negotiable Instruments Act presently pending before the learned Metropolitan Magistrate 18th Court, Calcutta.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the complainant in this case. The petitioner had filed the complaint in the year 2016. Since 2018, the matter has remained pending for cross-examination of P.W.1. On several occasions the accused prayed for time. In the interest of justice a direction may be passed to expedite the proceeding.

I have heard the submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

There is a statutory stipulation for conclusion of a proceeding under Section 138 of the N.I. Act. As the case is pending since 2016, it can fairly be stated that there has been an inordinate delay in dealing with the proceeding.

In view of the above and in the interest of justice, I request the learned Trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of six months from the next date of hearing.

With these observations, the revisional application is disposed of.
