Petitioner is aggrieved by the fact that in spite of informing the police authorities regarding the deception committed at the behest of the private respondents, no steps were taken by Raghunathganj Police Station. Petitioner complains that there has been a wrongful loss suffered by the petitioner. In spite of the same, the law enforcing agency did not aid the petitioner.
State has submitted a report. Report reflects that proceedings have been drawn up under Section 107 of the Cr.P.C.
Be that as it may, since the police authorities till date did not register a case, I direct that the petitioner would be at liberty to approach the jurisdictional Magistrate under Section 175(3) of the BNSS.
Learned Magistrate would assess and
ascertain regarding the genuinity of the accusations and as to whether any cognizable offences are made out, thereafter learned Magistrate would pass necessary directions as he deems fit and proper. With the aforesaid observations, WPA 7744 of 2024 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
