Affidavit of service filed on behalf of the petitioner is taken on record.

Petitioner claiming to be the unmarried daughter of a deceased Headteacher has claimed family pension due to death of her father. Father of the petitioner was in receipt of pension died on 8th February, 2018 and thereafter mother of the petitioner was receiving family pension who died on 2nd July, 2021. According to the petitioner due to death of her mother she is entitled to receive family pension being unmarried daughter.

State respondents are represented by learned advocate who has submitted that District Inspector of Schools (PE), Purba Medinipur issued memo dated 12th March, 2024 requesting the petitioner to submit certain documents for processing family pension case of the petitioner.

Having considered the submissions made on behalf of the parties and perusal of relevant documents available on record, it appears that pursuant to the memo dated 12th March, 2024 petitioner submitted requisite documents before the District Inspector of Schools (PE), Purba Medinipur as it emanates from page 19 of the writ petition.

In addition thereto, it also appears that income certificate has been furnished by Block Development Officer, Panskura-I, Purba Medinipur dated 25th October, 2023.

In view of aforesaid situation, it appears that petitioner has taken steps to comply with the directions of the concerned District Inspector of Schools (PE) for expeditious settlement of her family pension case.

Hence, the District Inspector of Schools (PE), Purba Medinipur being respondent no.4 is directed to settle the family pension case of the petitioner in accordance with law and take steps for release of family pension at an early date.

Family pension shall be released, if petitioner is otherwise eligible, as early as possible but not later than eight weeks from the date of communication of this order.

The writ petition stands disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
