... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated on the alleged recovery of about 50,000/- FICN. The petitioner is in custody for more than one year eight months and witness action has just commenced, as such, there is no possibility of the trial being concluded in the near future. Learned advocate, therefore, prays that the petitioner may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail.

It has been informed that there are 13 witnesses cited by the prosecution in the charge-sheet.

Having regard to the period of detention of the present petitioner, I direct the learned trial court that if the evidence of the prosecution witnesses is not complete within the next six months inspite of cooperation extended by the accused persons, the learned trial would release the petitioner on bail on such

terms and conditions as it deems fit and proper. The trial of this case would continue inspite of any resolution of the local bar. It is also directed that if a witness is present in court, in that case, without completion of the examination-in-chief and crossexamination of the said witness, the said witness should not be allowed to return.

Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 801 of 2026 is disposed of. The learned trial court would abide by the directions passed above.
