(DB) No. 1144 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Chinsurah Police Station Case No. 211 of 2021 dated 11.05.2021 under Sections 326/307 of the Indian Penal Code read with Sections 25/27 of the Arms Act.

And In Re : Sanjoy Das @ Shymal ..... petitioner Mr. Arunava Ganguly ... for the petitioner Mr. Madhusudan Sur, learned APP Mr. Manoranjan Mahata ... for the State Learned Counsel for the petitioner submits co-accuseds are on bail. He renews his prayer for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Firearm was recovered from the petitioner. Bullet head which was recovered from the body of the victim has matched with the firearm recovered from him. In view of the aforesaid incriminating materials on record, we are of the opinion petitioner does not stand on the same footing with the coaccuseds who are on bail. Accordingly, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
