Petitioner Mr. Arindam Jana Mr. Yuvraj Chatterjee Mr. Apurba Kumar Chakraborty Mr. Rahul Surtani ...for the petitioner Mr. Krishnendu Bhattacharyya Mr. Priyankar Ganguly ...Amicus Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is not the principal accused. The principal accused has already been arrested. The only allegation against the petitioner is that the principal accused had used the house of the petitioner to keep the minor victim girl confined. However, there are several contradictions in the statement made by the victim. She, even, refused to undergo medical examination. Charge sheet has been submitted.

Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that phone call records are available with the Investigating Agency. Phone calls were made at the relevant time between the petitioner and the other

accused. Moreover, the minor victim was kept kidnapped and kept in the petitioner's house and she was recovered from the said house. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
