Biswas .....For the State The present revisional application was preferred challenging Bashirhat Police Station Case No.1258 of 2020 dated 6.12.2020 under Sections 420/ 406/ 120B/ 34 of the Indian Penal Code. The order dated 16.04.2021 passed by the Co-ordinate Bench reflects that the investigation of the case was in progress at the stage at which the petitioner is approached. Since the registration of the case more than three years have been passed.
Md. Anwar Hossain, learned advocate appearing for the State submits that he has the Case Diary but the same is restricted to investigation being conducted till May, 2021.
Having considered the background in which the revisional application was preferred for quashing of the proceedings and the fact that there is bound to be change of circumstances, I am of the opinion that unnecessary pendency of this revisional application before this Court is unwarranted. Petitioner would be at liberty to canvas the points agitated in this revisional application at the stage of Sections 239/ 240 of the Code of Criminal Procedure, if so advised.
No interference is called for at this stage.
With the aforesaid observations, C.R.R. 879 of 2021 is disposed of. Pending applications, if any, are consequently disposed of.
