23.12.2020 b.das CRM 4027 of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Burdwan P.S. Case No.74 of 2019 dated 04.02.2019 under Sections 302/201/34 of the Indian Penal Code and read with Section 109/379/411 of the Indian Penal Code. And In the matter of: Manas Chaki @ Manabendra Chaki ....Petitioner.
Mr. S. Chatterjee ...for the Petitioner.
Ms. Faria Hossain Ms. B. Basu ...for the State.
Petitioner renews his prayer for bail. He is in custody for 665 days.
Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. Statements of witnesses disclose involvement of the petitioner in the alleged murder of the victim and as trial is in progress and his prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner at this stage. The application for bail is, thus rejected.
The trial court is directed to expedite the trial and conclude the same preferably within a year from the date so fixed for trial without granting any unnecessary arrangements.
