1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Matter is heard in presence of learned advocates representing the petitioner, State respondents and respondent no. 8.

3) It is submitted on behalf of the petitioner that concerned police authority did not take steps based on a complaint dated 11th March, 2026 lodged by the petitioner concerning an incident of abuse and threat on 10th March, 2026 by the respondent no. 8.

Petitioner prays for direction upon the concerned police

authority to take necessary steps taking note of the complaint dated 11th March, 2026.

4) Learned advocate representing the respondent no. 8 has opposed this writ petition on the ground that petitioner is unauthorizedly making construction in front of his premises impacting his ingress and egress. It is further submitted that respondent no. 8 has filed a writ petition being WPA 3273 of 2026 and same is running in the list before the Bench having determination wherein petitioner has prayed for certain direction in terms of relevant provisions of the West Bengal Highways Act, 1964. It is submitted that prayer was also made in that writ petition for removal of construction otherwise his ingress and egress would be affected.

5) On behalf of the State respondents a communication dated 30th March, 2026 of Officer-inCharge of Bagdah Police Station, North 24 Parganas is placed before this Court and same is taken on record. Copies of said communication are made over to learned advocates representing the petitioner and respondent no. 8.

6) It is disclosed in said communication dated 30th March, 2026 that in order to maintain peace and tranquility at the locale a prosecution being Bagdah Police Station NCR No. 159/26 dated 23rd March, 2026 under section 126 of the Bharatiya Nagarik Suraksha Sanhita, 2023 was submitted.

7) Inter se right of the parties over the land in front of the premises of respondent no. 8 needs to be decided by the appropriate forum which ought not to be dealt with in the present writ petition. However, concerned police authorities are directed to maintain peace and tranquility at the locale and keep vigil.

8) Writ petition stands disposed of.

9) There shall be no order as to costs.

10) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
