AND In the matter of:- Lal Deo Roy ... petitioner The revisional application was preferred against the proceedings relating to C.R. Case no.795 of 2011, pending before the learned Judicial Magistrate, 2nd Court, Siliguri. Having regard to the fact that the petitioner has not pursued the revisional application since the year 2012 and the main issue involved in the revisional application is that a civil dispute has been given the colour of the criminal proceedings and the interim order in this case has not been extended after 10th of October, 2012, I am of the view that it would not be fit and proper to interfere at this belated stage without any information being furnished to this Court regarding the present stage of proceedings before learned court.
Accordingly, C.R.R.980 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any is hereby vacated.
Petitioner will be at liberty to take up the points agitated in the revisional application at the appropriate stage of the case before the trial court if the same is pending till date.
