The writ petitioner claims rights under a partition decree passed by the learned Civil Judge(Senior Division), Islampur, Uttar Dinajpur in Partition Suit No. 208 of 2015. Final decree has been passed based on a Commissioner's report.

The actual demarcation of the extent of land of each of the co-sharers has not occurred.

The petitioner may put the decree into execution and seek actual demarcation through the local Amin. The Karandighi Police Station has taken steps on the petitioner's complaint of intimidation and assault by the private respondents. Proceeding under Section 107 of the Cr. P. C. have been drawn up. The police shall maintain regular vigil on the property-inquestion to ensure that there is no breach of peace in the area.

The writ petition is disposed of.

There will be no order as to costs.
