Petitioner is aggrieved by the fact that in spite of specific information relating to cognizable offences being committed at the behest of the private respondents, no steps were taken by the police authorities.

Additionally, certain offences were committed in presence of the police authorities. Learned advocate for the State is present.

Having considered that the informations were sent on or about 27th February, 2024 and till date no steps have been taken, I direct the petitioner would approach the jurisdictional Magistrate under Section 175(3) of the BNSS. Learned Magistrate would assess and ascertain regarding the correctness of the accusations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, WPA 7809 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
