Affidavit-of-service filed on behalf of the petitioner is taken on record.

It is submitted that marital acrimony pending between the petitioner and her husband being respondent no.5 gave rise to initiation of criminal prosecution being Thakurpukur P.S. Case No.281 of 2025 dated 19th August, 2025 under Section 498A of Indian Penal Code.

It is submitted on behalf of the petitioner that during pendency of such proceeding, respondent no.5 stopped supply of water to the accommodation of the petitioner, who is staying at the same premises where respondent no.5 stays, which prompted the petitioner to approach this Court with the present writ petition.

Petitioner prays for direction upon the concerned police authority which would facilitate supply of water to the accommodation of the petitioner.

Respondent no.5 is not represented today.

State respondents are represented by learned advocates.

Learned advocate representing the State respondents has filed a communication dated 6th April, 2026 of Officer-in-Charge, Thakurpukur Police Station, Kolkata and same is taken on record. Copy of the said communication dated 6th April, 2026 is made over to the learned advocate representing the petitioner. 8.
It is disclosed in the said communication dated 6th April, 2026 that in connection with criminal prosecution being Thakurpukur P.S. Case No.281 of 2025 dated 19th August, 2025, charge-sheet was submitted being no.249 of 2025 dated 18th September, 2025 before the jurisdictional Magistrate. It is also disclosed that petitioner initiated a proceeding before the appropriate forum under the Protection of Women from Domestic Violence Act, 2005 and same is pending.

Having considered the respective submissions made on behalf of the petitioner and the State respondents and taking note of the contents of the said communication dated 6th April, 2026, it appears that
[3] petitioner is aggrieved due to non-supply of water to her accommodation at the instance of the respondent no.5.

Police authority is not the appropriate authority to take steps ensuring supply of water to the accommodation of the petitioner.

Petitioner shall be at liberty to approach the concerned authority of Kolkata Municipal Corporation for taking necessary steps in order to ensure supply of water to her accommodation.

Petitioner shall also be at liberty to approach the appropriate forum in connection with the proceeding drawn up under the Protection of Women from Domestic Violence Act, 2005.

In view of aforesaid, Court is not inclined to interfere with the writ petition.

Writ petition stands dismissed.
