As none appears for the State, Mr. Anwar Hossain, learned advocate who usually appears on behalf of the State is directed to represent the State. His appointment may be regularized by the concerned authorities in due course. The subject matter of the revisional application relates to an order of acquittal dated 3rd March, 2006 passed by the learned Judicial Magistrate, 3rd Court, Durgapur in connection with G. R. Case No. 367 of 1996(arising out of New Town P. S. Case No. 35/96 dated 22.04.96) under Section 498A of the Indian Penal Code.
The record of this revisional application reflects that till date the revisional application has not been admitted and no information ha been furnished before this court as to whether there was compliance of the order dated 5th May, 2009 regarding service of the application under Section 5 fo the Limitation Act. In view of the fact that the subject matter relates to an order of acquittal, and in respect of an order of March, 2006, i.e., more than 16 years ago, I am of the opinion that no purpose would be served by keeping the revisional application pending.
Accordingly, the revisional application being CRR 1105 of 2007 is dismissed Pending applications, if any, are consequently disposed of. Interim order, if any, is hereby vacated.
