For the appellant Mr. Kar, learned senior advocate appearing for the appellant submits that the present appeal has been preferred against an interim order dated 21st January, 2016 passed in W.P. No. 23423 (W) of 2015 and that during pendency of the present appeal, the writ petition being W. P. No. 23423 (W) of 2015 has been finally heard and dismissed upon contested hearing by an order dated 21st December, 2018. Let a copy of the said order, as produced, be kept on record.

In view thereof, the present appeal has become infructuous and the same along with the application being CAN 1 of 2016 (Old CAN 5133 of 2016) are dismissed.
