The petitioner has inherited a shop room from her husband. She fell ill and handed over the said shop room to her daughter and son-in-law, the respondent nos.6 & 7. After the petitioner recovered in health, the respondent nos.6 & 7 refused to hand over the said shop room to the petitioner.

On the petitioner's complaint, a FIR was registered by Bauria Police Station, Howrah Rural District and a charge-sheet being 79 of 2022 dated 24th May, 2022 under Sections 24 and 25 of the Maintenance & Welfare of Parents and Senior Citizen Act, 2007 has been filed.

In view of the above, this Court finds that there is no inaction on the part of the police.

The instructions of the Officer-in-charge, Bauria Police Station, Howrah Rural District dated 24th January, 2023 addressed to the State Advocate be taken on record.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
