The petitioner claims interest on delayed payment of terminal benefits.

The petitioner superannuated from service of the WBTCL on September 30, 2015. He received his terminal benefits of Rs.12,53,642/- towards provident fund and gratuity on 03.02.2016 and Rs. 3,01,780/- towards leave encashment on 15.02.2016.

The petitioner is entitled to interest for the period from 01.10.2015 to 03.02.2016 at the rate of 6 per cent per annum towards provident fund and gratuity and from 01.10.2015 to 15.02.2016 at the rate of 6 per cent per annum towards leave encashment. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.
