Petitioner approached this Court being aggrieved by the manner in which the investigation progressed. Another part of the grievance was relating to the petitioner and her family members being coerced for settlement.
I find that in connection with Nabadwip P.S.
Case No.760 of 2024, charge-sheet was submitted on or about 10.09.2025.
Petitioner complains that there has been threat at the behest of unknown persons including the accused.
Having considered the same, I direct that in case an application is made before the learned Magistrate in seisin of Nabadwip P.S. Case No.760 of 2024, learned Magistrate would pass necessary directions under the Witness Protection Scheme, 2018.
Further, if the petitioner is aggrieved by the outcome of the investigation, petitioner would be at
liberty to take out appropriate application under Section 193 of BNSS. Learned Magistrate would assess regarding the grievance of the petitioner vis-a-vis the materials collected by the investigating agency and thereafter pass necessary directions in accordance with law.
With the aforesaid observations, the writ petition being WPA 7212 of 2025 is disposed of. Case diary be returned to the learned advocate appearing for the State.
A copy of the report be handed over to the learned advocate appearing for the petitioner. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
