Case No. 136 of 2019 pending before the Court of learned Judge, Special Court under N.D.P.S. Act, 5th Court, Berhampore, Murshidabad. Learned advocate for the petitioner submits that out of eight witnesses, four witnesses have been examined so far and, thereafter, the trial of the case has not proceeded.
During the pandemic situation, delay in disposal of the trial cannot be attributed to the learned Judge in the Court below. However, keeping in the mind, the innocuous nature of the prayer of the petitioner, this revisional application is disposed of with a direction upon the learned Judge, Special Court, NDPS Act, Berhampore, Murshidabad to conclude the trial within a period of one year from the date of resumption of the normal functioning of the Court. The revisional application being CRR 886 of 2021 is disposed of. All parties shall act upon the server copy of this order duly downloaded from the official website of this Court. (Kausik Chanda, J.)
