And In Re : Injam Ul Haque Mandal ... Petitioner.

Mr. Arkoproho Roy ... For the Petitioner.

Atif Ahmed Siddiqui ... For the State.

Mr. Anish Roy ... For the Opposite Party no. 2 The petitioner is in custody for about 4 months. Learned counsel for the petitioner submits that the petitioner has been falsely implicated. Charge-sheet has been submitted. His further detention is not required.

Learned counsel for the State opposes the prayer. Learned counsel for the defacto complainant submits that he has no objection if the petitioner is released on bail. Considering the material on record particularly the period of detention of the petitioner and the fact that charge-sheet has been submitted, this Court is of the view that further detention of the petitioner is not required and he may be released on bail. Accordingly, the prayer for bail is allowed.

The petitioner namely Injam Ul Haque Mandal shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Khatra, Bankura subject to condition

that he shall appear before the learned trial Court on every date of hearing fixed by the learned trial Court and he shall not tamper with the evidence and intimidate the witnesses in any manner whatsoever.

In the event the petitioner fails to appear before the learned trial Court on any date fixed for hearing without any justifiable reason, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. The application for bail, being CRM (SB) 45 of 2025, is, thus, disposed of.
