C.R.A. 187 of 2001 In the matter of: Satish Chandra Bhowmick ......Appellant.

The instant appeal has been preferred by the appellant, Satish Chandra Bhowmick under Section 378(4) of the Cr.P.C. against the judgment and order of acquittal dated 14.2.2001 passed by learned Judicial Magistrate, 2nd Court, Tamluk in C. Case No. 1064C/1996 under Section 379 of the IPC.

The matter is listed today for hearing of the appeal and for compliance of the earlier order relating to issuance of administrative notice upon the appellant and the respondent. Report has been submitted in compliance of the order passed by this Court. Let it be kept with the record.

It has been reported that the appellant, Satish Chandra Bhowmick has expired on 12.9.2016. A copy of the Death Certificate has been annexed therewith.

On call, none appears for the appellant and the respondent. Having considered the facts situation, it is ordered that the instant appeal has abated under Section 394(2) of the Cr.P.C.

Let a copy of this order along with the Lower Court Records be returned to the learned Judicial Magistrate, 2nd Court, Tamluk for information.
