Samirul Sk @ Samiruddin Sk @ Rafi v. State Of West Bengal
23.06.2026 Serial no. 58 [G.S.D] CRM (M) 804 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Beldanga PS Case No. 81 of 2025 dated 09.02.2025 u/s 85/118(2)/109/3(5) of the BNS read with sections 3/4 of the DP Act, GR No. 808 of 2025.
-AndIn the matter of : Samirul Sk. @ Samiruddin Sk. @ Rafi ... Petitioner(s) Mr. Arnab Kumar Neogi Mr. Sourav Samanta ... for the Petitioner(s) Mr. Gouranga Kr. Das, ld. APP Mr. Neel Chakraborty ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than one year and charge-sheet has already been submitted, as such, he prays that the petitioner may be released on bail.
Learned advocate for the State, on the other hand, opposes the prayer for bail and draws the attention of the court to the statement of the victim. The medical examination of the victim also reflects that she was set on fire by the petitioner and others. The statement before the doctor specifically mentions the complicity of the present petitioner.
It has been informed that the present case till date has not been committed to the court of Sessions as some of the accused persons are still absconding.
Having considered the heinousness of the offence inflicted upon the helpless housewife, I am not inclined to enlarge the petitioner on bail at this stage.
Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 804 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
