gd/ssd Mr. Sutirtha Das ..for the Petitioners Mr. Jahar Lal De, Mr. Supratim Dhar ..for the State Learned counsel for the petitioners submits that the petitioners want to withdraw this petition. Having regard to the fact that it is a petition filed in the public interest and also considering the nature of controversy involved in the matter, we decline the prayer for withdrawal.
A perusal of the record reveals that there is an allegation in respect of the misappropriation of the huge amount of Rs.1 crore which was allotted for Mission Million Dream i.e. MMD/horticulture work under the MGNREGA Scheme under Chandrapara Gram Panchayat in Chanchal-II Block, Malda. The record reflects that the tender for the said scheme was floated by the concerned Prodhan and there was an allegation of illegal process in tendering and order for stoppage of work yet the amount was disbursed to the contractor by the Prodhan. Block Development Officer, Chanchal Development Block, Malda had sent the communication dated 11.11.2020 to the Prodhan which indicates that
the enquiry was in progress in respect of the allegation. In the aforesaid background we feel that once the enquiry was initiated, it should be completed to ascertain the truthfulness of the allegation. The representation, annexure "P-1", dated 15.10.2020 was addressed to the Sub-Divisional Officer, Chanchal Sub-Division Malda i.e.
the respondent no.7. Hence, we direct the respondent no.7 to duly look into the allegation and conduct an enquiry in accordance with law after giving an opportunity of hearing to all the concerned parties and in case, if any irregularity in the process is found, then to take immediate action against the persons responsible for the same.
Let this exercise be completed within a period of three months from the date of receipt of a copy of this order.
Learned counsel for the State is directed to communicate this order to the respondent no.7 without any delay.
The petition is, accordingly, disposed of.
