Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent no. 2 and 3, the District Primary School Council, Malda to grant transfer of the petitioner to any educational institution within the jurisdiction of Malda South Circle at the earliest. 3.

Mr. Dipayan Kundu, learned advocate appearing for the petitioner submits that the petitioner is an Assistant Teacher of A. K. Gopalan Colony Primary School. On 27th August, 2021, the petitioner lodged a complaint against one Mithu Das, a civic volunteer with the allegation of ravishing her. On such complaint, English Bazar Police Station Case No. 1240 of 2021 dated 21st September, 2021 under Sections

376/506 Indian Penal Code was initiated against the said accused. Subsequent thereto, the accused has been granted bail. However, there is continuous threat upon the petitioner for which reason the petitioner made an application seeking transfer from the said school. The petitioner due to her absence from school has been served with show cause notice and she has also replied to such show cause notice. Hearing has been conducted by the District Primary School Council, Malda, however, till date, no steps have yet been taken. Hence this writ petition.

Mr. Avishek Prasad, learned advocate appearing for the District Primary School Council, Malda submits that the matter be relegated to the appropriate authority for taking a decision in respect of the representation of the petitioner dated 10th February, 2025.

In view of the above, respondent no. 3, the Chairman, District Primary School Council, Malda is directed to consider the representation of the petitioner dated 10th February, 2025 seeking transfer and dispose of the same in accordance with law by passing a reasoned order upon giving notice to the petitioner within a period of six weeks from the date of communication of this order.

Such reasoned order shall be communicated to the petitioner within a period of one week from the date of passing of such order.

Learned advocate for the petitioner is directed to communicate this order to the respondent no. 3, the

District Primary School Council, Malda for necessary action.

With the above direction, the writ petition being WPA 7236 of 2025 stands disposed of.

9.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 10.

Interim order, if any, stands vacated.

11.

All connected applications, if any, stand disposed of. 12.

There shall be no order as to costs.

13.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
