The petitioner claims interest on delayed payment of terminal benefits.

The petitioner superannuated from service of the WBTCL on December 31, 2014. He received his terminal benefits of Rs.8,94,442/- towards provident fund on 23.04.2015 and Rs. 6,13,108/- towards gratuity and leave encashment on 17.08.2015.

The petitioner is entitled to interest for the period from 01.01.2015 to 23.04.2015 at the rate of 6 per cent per annum towards provident fund and and from 01.01.2015 to 17.08.2015 at the rate of 6 per cent per annum towards gratuity and leave encashment. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.
