The petitioner claims interest on delayed payment of terminal benefits.

The petitioner superannuated from service of the WBTCL on January 31, 2019. He received his terminal benefits of Rs.1,52,145/- towards 1st instalment of provident fund on 17.05.2019 and Rs. 1,52,145/- towards 2nd instalment of Provident Fund on 10.06.2019 and Rs. 11,95,225/- towards gratuity and leave encashment on 17.05.2019.

The petitioner is entitled to interest for the period from 01.02.2019 to 17.05.2019 at the rate of 6 per cent per annum towards 1st instalment of provident fund and from 01.02.2019 to 10.06.2019 at the rate of 6 per cent per annum towards 2nd

instalment of Provident Fund and from 01.02.2019 to 17.05.2019 towards gratuity and leave encashment at the rate of 6 per cent per annum. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.
