The affidavit of service filed by the learned advocate on behalf of the petitioner be taken on record. The petitioner is aggrieved by non-consideration of his representation dated January 24, 2025 made to the respondent no.2 i.e. the Regional Transport Authority, Pschim Medinipur. By the said representation the petitioner has alleged that the permit for plying a bus bearing No. WB 33 F 2197 on the route of Jhilimili to Kharagpur has been illegally granted in favour of the respondent no.8. It is submitted that the said representation has been lying with the respondent no.2 for a substantial time without any decision being taken thereon.
Mr. Roy, learned advocate appearing for the respondent no.8 submits that the allegation levelled by the petitioner in the said representation is wholly unfounded.
Having heard the learned advocates appearing for the respective parties and having considered the material on record, this Court is of the view that justice would be sub-served if the present writ petition is disposed of by directing the respondent no.2 to consider and dispose of the petitioner's representation dated January 24, 2025 strictly in accordance with law by passing a reasoned order upon considering all the relevant material and upon giving an opportunity of hearing to the petitioner and the respondent no.8, i.e. Tapan Singh within a period of eight weeks from the date of communication of this order. It is made clear that the petitioner as well as the respondent no.8 shall be entitled to produce all documents in support of their respective cases, which shall be duly considered by the respondent no.2 for the purpose of taking a decision on the petitioner's said representation.
Needless to mention that the reasoned order passed by the respondent no.2 within the aforesaid time frame shall be communicated to the parties within a week from passing thereof.
With the above observations, WPA 7161 of 2025 is disposed of.
There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
