Affidavit of service filed by the petitioner is taken on record.

The respondents are not represented despite service. Learned counsel for the petitioner submits that the Panchayat started construction of a road by encroaching his land for which he submitted a representation before the concerned authority ventilating his grievance. Since the representation was not considered, the petitioner approached this Court in a writ petition being WP 15589 (W) of 2018. By an order passed on 30th November, 2018, a coordinate Bench of this Court directed the Block Development Officer, Raipur Block, District Bankura, being the 5th respondent herein, to hear the writ petitioners and Panchayat and pass a reasoned order within a stipulated time frame.

Learned counsel submits that despite such order, several notices of hearing were issued by the authority upon the petitioner and others but no reasoned order has been passed till date.

In view of the fact that the order passed by the coordinate Bench of this Court on 30th November, 2018 is yet to be complied with, the 5th respondent is directed to

comply with the said order within four weeks from the date of communication of the order, in accordance with law positively.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
